The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the tension triggered by the presentation of a new 28-article proposal for ending the war appeared – momentarily – to have been stabilised. A senior US official spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of opposing developments captured the harsh reality of the recent timeframe. By day, negotiation efforts are fought: optimistic declarations are released from multiple capitals. Considerable effort is devoted on managing particular approaches. By night, the Kremlin brutally reminds the world that, for them, war remains the main instrument for achieving "settlement".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor missile launches from Russian territory, a ability enabled by current data. From witness perspectives, military aircraft that had been deployed to intercept incoming aerial threats streaked across the sky – advanced fighter aircraft provided to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems engaged: defensive missiles targeted at a incoming threat. This was a modern interception technology at work, most likely provided by allied countries. Every launch shakes the surroundings, causing tremors. The instant of fear quickly transforms into grim resignation: possibly the incoming missile won't cause damage this time, sparing the city from devastation and additional electricity failures.

Persistent Threats

Not long after, a large-caliber weapon fired at a aerial vehicle in the vicinity, part of a defensive team – most likely imported technology. Regrettably, the shots failed to hit the hostile drone – it pressed on overhead toward its destination.

With pauses, this persisted until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, devastation and heating outages in numerous residences as a result of the night's assault. As customarily, everyone still continued their routines – living the war. But those entire period demonstrated Ukraine's essential dependence on Western support – a need that European nations are evidently unprepared to replace in the near term.

Ineffective Peace Efforts

The 28-point plan from US administration sparked intense emotion, discussion and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This trend will, undoubtedly, endure.

Political Considerations

It is convenient to criticize particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the complete picture. American leadership works based on a premise familiar among seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The White House assumes that it is unrealistic to pressure the Kremlin to abandon the areas that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, Washington does minimal to prevent Kremlin actions, through statements or actions, from assuming that the status quo will not change more in its favour in the months ahead.

Opposing Positions

Therefore, Moscow is certain that time is on his side – that Ukraine and its supporters are coming close to fatigue. Their incentive to accept conditions that does not give them the largest achievable advantage is close to zero. There may be many attempts to stop fighting, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing lives and land but preventing a total frontline collapse until circumstances change in its benefit.

Current Realities

Objectively, there are no real preconditions for a ceasefire. Now, subjective factors are becoming relevant: personal goals to broker a ceasefire and secure international recognition, and the government's double obstacles – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unworkable, so that their focus does not move to domestic problems. And although their objective will now be considerably more difficult after current events, it remains very improbable that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a only one week to eliminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, latest revelations, all served their function.

While new proposals based on previous concepts are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and reflect certain reluctance to alter the situation, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, largely rely on sustained allied backing.
